Terms of Use
These terms are an agreement between you and Cory Ray Lund ("we", "us") covering your use of the Waffle Tracker website and app (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. Who can use it
You must be at least 18 years old and able to enter into a binding agreement. Each account is for one person.
2. What Waffle Tracker is, and isn't
Waffle Tracker is a record-keeping tool. It helps you keep track of debts, trades and shipments between you and other people. It is not a payment service, escrow service, marketplace, exchange, or gaming or gambling service.
- We never hold, move, ship or guarantee any money, metal or other property.
- We're not a party to any deal between you and anyone else, and we can't settle disputes between users.
- The records and totals in the app are calculated from what you and your friends enter. Check them before relying on them.
- You're responsible for following the laws that apply to your own activities, including laws on taxes, shipping, raffles, sweepstakes and gambling. Don't use the Service for anything unlawful.
3. Your account
Keep your login details secure and your information accurate. You're responsible for activity on your account, including through any API token you create. Tell us right away if you think someone else has accessed it.
4. Free plan, Pro and subscriptions
- The Service has a free plan and a paid plan, Pro, which adds features such as live package tracking, groups, photos, reminders and history. We may change which features are in each plan.
- New accounts get a free 30-day trial of Pro. When it ends, the account continues on the free plan unless you subscribe. Information saved with Pro features is kept, and is available again if you subscribe later.
- Subscriptions are billed monthly or yearly through Stripe, on our website. They are not purchased through Apple or the App Store, and Apple isn't responsible for them.
- A subscription renews automatically at the then-current price until you cancel. You can cancel at any time from the Billing tab in Settings. Cancelling stops future charges, and you keep Pro until the end of the period you've paid for.
- Payments are non-refundable, including for partly used periods, except where the law requires otherwise.
- We'll give you notice before changing the price, and the new price applies from your next renewal.
- If we've agreed in writing to another payment method, the same terms apply to that Pro access.
5. Your content
You keep ownership of what you put into the Service. You give us permission to store, process and display it only as needed to run the Service for you, including showing it to the friends and groups you choose to share with.
When you add information about other people, such as names and shipping addresses, you confirm you have the right to use it for this purpose.
6. Acceptable use
Don't:
- use the Service to harass, threaten, defraud or mislead anyone;
- enter information you have no right to, or use other people's information to harm them;
- try to get into accounts or data that aren't yours, or interfere with the Service's security or operation;
- scrape, overload or reverse-engineer the Service, or resell access to it.
7. Other services
Some features rely on other companies, such as Stripe for payments, Ship24 for tracking status and Geoapify for address suggestions. Tracking updates, delivery estimates and address suggestions come from those services and may be late or wrong.
8. Ending your account
You can delete your account at any time under Settings → Account Info → Delete my account. We may suspend or close an account that breaks these terms, or if the law requires us to. If we close your account without cause, we'll refund the unused part of any subscription. Sections 2 and 9 through 12 continue to apply after your account ends.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including that the Service will be uninterrupted, error-free or fit for a particular purpose. Keep your own records of anything important.
10. Limitation of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special or consequential damages, or for lost property, profits or data, arising from your use of the Service. That includes losses from deals between users and from wrong tracking or calculation results. Our total liability for any claim related to the Service is limited to the greater of what you paid us in the 12 months before the claim and $50.
11. Indemnity
You agree to cover our losses and costs, including reasonable legal fees, from claims arising out of your content, your dealings with other people, or your breaking these terms.
12. Governing law
These terms are governed by the laws of Michigan, United States, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts located in Michigan, unless the law where you live gives you the right to bring them elsewhere.
13. If you use the iOS app
If you downloaded Waffle Tracker from Apple's App Store, these extra terms apply:
- These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
- Your license to use the app is non-transferable and limited to Apple-branded devices you own or control, as the App Store's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you can notify Apple, and Apple will refund the app's purchase price, if any. Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- We, not Apple, are responsible for investigating and handling any claim that the app infringes someone else's intellectual property.
- You confirm you're not located in a country subject to a U.S. government embargo, and you're not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms. We'll update the date at the top, and for significant changes we'll let you know in the app or by email before they take effect. If you keep using the Service after that, you accept the new terms.
